Terms & conditions of sale
1. About us
These terms apply to all quotes, orders and supplies made by Cheshire Doors and Bifolds Limited ("we", "us", "our"), a company registered in England and Wales under company number 13854812. You can contact us by email at info@cheshire-d-b.co.uk or by phone on 07376 141045.
In these terms, "you" means the person or business placing the order. Where you buy as a consumer (for purposes wholly or mainly outside your trade, business, craft or profession), some sections apply differently, and nothing in these terms affects your statutory rights.
2. Quotes
Our quotes are based on the information, sizes and specification you give us. A quote is valid for 30 days unless it says otherwise. Each quote states whether prices include VAT and what is included, such as delivery and any installation. Prices shown on our website, in brochures or in conversation are a guide only until confirmed in a written quote.
We aim to check every specification with you, but we may correct obvious errors in a quote or order confirmation before your order is placed with the manufacturer.
3. Placing an order
A contract is formed when we confirm your order in writing (including by email) and receive any deposit stated on your quote. Please check the order confirmation carefully, including sizes, colours, glass, opening direction, hardware and quantities, and tell us straight away if anything is wrong. We supply products from specialist manufacturers. Once your order has been placed with the manufacturer, it may not be possible to change it, and any changes the manufacturer can make may carry an extra charge.
4. Measurements
The products we supply are made to measure by our manufacturers. Where you supply the sizes, you are responsible for their accuracy, and your products will be ordered and made to the sizes you confirm in your order. If you are unsure, send us photos and we will help you, or ask us about a survey. We are not responsible for products that do not fit because sizes supplied by you or your builder were wrong.
5. Payment
Payment terms are set out on your quote. Unless agreed otherwise, a deposit is payable when you place your order and the balance is payable before dispatch or on delivery. Products remain our property until we have received payment in full, but risk passes to you on delivery.
6. Delivery
We deliver throughout the UK. Delivery dates are estimates and depend on our manufacturers' lead times; we will keep you informed and do our best to meet them, but we are not liable for delays caused by events outside our reasonable control.
Someone must be available to receive the delivery and there must be safe, reasonable access. Please inspect your products when they arrive and note any visible damage or missing items on the delivery note, then tell us within 48 hours with photos. Glass and frames should be stored upright, in a dry place, and protected until fitted.
7. Your right to cancel (consumers)
If you are a consumer and the contract is made at a distance (for example online, by email or by phone) or away from our premises, you normally have 14 days to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
This right does not apply to goods made to your specifications or clearly personalised, which includes made-to-measure doors, windows and glazed units. Once you have confirmed a made-to-measure order, you cannot cancel it under these regulations. For any standard, non-bespoke items, you may cancel within 14 days of delivery by telling us clearly; you must return the goods unused and in their original condition, and we will refund you within 14 days of receiving them.
Business customers do not have a statutory right to cancel.
8. Installation
Unless your quote includes installation by us, products are supplied only. If your products are fitted by you or someone you appoint, the fitter is responsible for the installation and for complying with Building Regulations, and we are not responsible for faults caused by incorrect installation, structural issues or preparation of the opening. Where we do install, the scope of the work is set out in your quote.
9. Guarantees and faulty goods
We are a supplier, not a manufacturer. The products we supply come with the manufacturer's guarantee stated in the product literature or your quote (for example, a 10-year guarantee on aluminium products). We will deal with guarantee claims on your behalf with the manufacturer. Guarantees cover manufacturing defects and do not cover fair wear and tear, misuse, damage after delivery, incorrect installation or lack of reasonable maintenance.
If you are a consumer, you also have legal rights under the Consumer Rights Act 2015: goods must be as described, fit for purpose and of satisfactory quality. If something is wrong, contact us: as the seller, we are responsible to you under those rights, and we will put it right in line with them, working with the manufacturer where needed. Our guarantees are in addition to these rights and do not reduce them.
10. Colours, images and descriptions
Images, drawings and colour previews on our website and in brochures are for illustration only. Colours vary between screens, printed material and finished products, so please ask for a sample if the exact shade matters. Woodgrain foils and powder-coated finishes vary naturally. Products may differ slightly from images as manufacturers improve their designs.
11. Our liability
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be excluded or limited.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable.
If you are a business customer, we are not liable for any loss of profit, loss of business, business interruption or indirect or consequential loss, and our total liability to you in connection with any order is limited to the price paid for that order.
12. Events outside our control
We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as manufacturer or supplier delays, severe weather, transport disruption or industrial action. If this happens, we will contact you as soon as possible and agree a revised date.
13. Complaints
If you are unhappy with anything, please contact us at info@cheshire-d-b.co.uk or on 07376 141045 and we will do our best to resolve it quickly.
14. General
These terms, together with your quote and order confirmation, form the whole agreement between us. If any part of these terms is found to be unenforceable, the rest will still apply. These terms are governed by the law of England and Wales. If you are a consumer, you may bring proceedings in the courts of England and Wales, or in Scotland or Northern Ireland if you live there.
